OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to fall, crushing and struck-by hazards while riding on a bucket of a Case Skid Steer: a) On December 6, 2022, employees were exposed to fall, crushing and struck-by hazards while riding inside of a bucket attached to a Case Skid Steer as a means of transportation between different sites. Among other method, one feasible and acceptable method to correct this hazard is to follow the general safety requirements outlined in the Association of Equipment Manufacturers (AEM), Safety Manual for Operating and Maintenance Personnel for Skid Steer Loaders, and not allow riders in the bucket. No abatement certification or documentation is required for this item.
