29 CFR  1910.37(a)(3): The employer failed to have exit routes free and unobstructed. No materials or equipment may be placed, either permanently or temporarily, within the exit route. The exit access must not go through a room that can be locked, such as a bathroom, to reach an exit or exit discharge, nor may it lead into a dead-end corridor. Stairs or a ramp must be provided where the exit route is not substantially level.  On or about December 7, 2023 the employer failed to keep access to the exit door on the east wall near the welding area free of debris and metal parts that employees had to step over to access the door in case of an emergency.

29 CFR  1910.178(l)(2)(ii): The employer failed to have training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  On or about December 7, 2023 the employer failed to provide a form of formal instruction to employees that operate the Linde forklifts used inside of the facility, giving employees insufficient training on the use of forklifts exposing operators and other employees to struck-by hazards associated with forklift operation.

29 CFR 1910.243(c)(3): The employer failed to have safety guards on machines known as right angle head or vertical portable grinders with a maximum exposure angle of 180 degrees, and the guard located so as to be between the operator and the wheel during use. Adjustment of guard shall be such that pieces of an accidentally broken wheel will be deflected away from the operator.  On or about December 7, 2023 the employer failed to ensure that handheld angle grinders used throughout the facility had safety guards on them when in operation to protect employees from debris caused by the grinding operation and debris from a wheel breaking apart and striking the employee's face or body.

29 CFR  1910.1200(e)(1): Employers failed to develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria for labels and other forms of warning, safety data sheets, and employee information and training will be met.  On or about December 7, 2023 the employer failed to develop and maintain a written Hazard Communication (HAZCOM) program for forklift operators. The operators are responsible for changing out the propane tanks for the Linde forklifts used in the workplace. The propane used to power the different forklifts can leak out when changing the tanks exposing the forklift operators to chemical hazards from the propane.

29 CFR  1910.1200(h)(1): Employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  On or about December 7, 2022 the employer failed to develop and maintain a written training program for employees that handle products, including propane, that are considered hazardous materials under the Hazard Communication (HAZCOM) program. The forklift operators are responsible for changing out the propane tanks for the Linde forklifts used in the workplace. The propane used to power the different forklifts can leak out when changing the tanks exposing the forklift operators to chemical hazards from the propane including chemicals burns or additional fire or explosion hazards.
