29 CFR  1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence: (1) Preparation for shutdown. Before an authorized or affected employee turns off a machine or equipment, the authorized employee shall have knowledge of the type and magnitude of the energy, the hazards of the energy to be controlled, and the method or means to control the energy. (2) Machine or equipment shutdown. The machine or equipment shall be turned off or shut down using the procedures established for the machine or equipment. An orderly shutdown must be utilized to avoid any additional or increased hazard(s) to employees as a result of the equipment stoppage. (3) Machine or equipment isolation. All energy isolating devices that are needed to control the energy to the machine or equipment shall be physically located and operated in such a manner as to isolate the machine or equipment from the energy source(s). (4) Lockout or tagout device application. (i) Lockout or tagout devices shall be affixed to each energy isolating device by authorized employees. (ii) Lockout devices, where used, shall be affixed in a manner to that will hold the energy isolating devices in a "safe" or "off" position. (6) Verification of isolation. Prior to starting work on machines or equipment that have been locked out or tagged out, the authorized employee shall verify that isolation and deenergization of the machine or equipment have been accomplished.  a) On or about October 14, 2022 in the shop, the operator and supervisor unjamming the 415 Rouselle Punch Press Model 2F SN21567, full revolution mechanical power press,  were exposed to a caught between hazard at the dies due to not applying the following required elements of a lockout procedure: 1. The operator was not an authorized employee, and operator and supervisor were not sufficiently trained to recognize the hazard caused by gravity energy; 2. the punch press was not turned off; 4. no isolation devices  and  locks were placed on energy sources such as electrical and gravity;  5. no locks or tags were applied on the equipment energy sources; and 6. no restart or other testing was performed to verify that the energy was isolated.  b) On or about November 6, 2022 in the shop, the supervisor and the operator of the 415 Rouselle Punch Press Model 2F SN21567 when performing die changes were  exposed to a caught between hazard  at the dies and fly wheel due to not applying the following required elements of a lockout procedure: 1. The operator was not an authorized employee, and employees were not sufficiently trained to recognize the hazard caused by gravity energy; 2. the procedure incorrectly identified a pneumatic energy source; 3. no blocks were under the ram to isolate the gravity energy;  4. the operator was not provided locks or tags for the electrical energy sources; and 5. no restart or other testing was performed to verify that the energy was isolated.  c) On or about December 6, 2022 in the shop, the supervisor who was performing maintenance on the 415 Rouselle Punch Press Model 2F SN21567 was  exposed to a caught between hazard at the dies and fly wheel due to not applying the following required elements of a lockout procedure: 1. Supervisor was not sufficiently trained to recognize the hazard caused by gravity energy; 2. no blocks were under the ram to isolate the gravity energy; and 3. no restart or other testing was performed to verify that the energy was isolated.

29 CFR  1910.217(c)(1)(i): It shall be the responsibility of the employer to provide and insure the usage of "point of operation guards" or properly applied and adjusted point of operation devices on every operation performed on a mechanical power press. See Table O-10.  a) On or about October 14, 2022, the employer did not ensure that a  guard at the point of operation in that the Rouselle 415 Punch Press Model 2F SN 21567, a full revolution mechanical power press,  was not guarded on the left side of the dies, exposing employees to caught between hazards at the dies.

It shall be the responsibility of the employer to insure the original and continuing competence of personnel caring for, inspecting, and maintaining power presses.  a) On or about October 14, 2022, the employer did not ensure that maintenance personnel were properly trained in inspecting mechanical power presses such as but not limited to the 415 Rouselle Punch Press Model 2F SN21567, a full revolution mechanical power press, in that there was a missing barrier guard on the left side at the point of operation of the dies, exposing employees to caught in hazards.

The employer shall insure by adequate supervision that correct operating procedures are being followed.  a) On or about October 14, 2022, the employer did not provide adequate training and instruction to the operators of the 415 Rouselle Punch Press Model 2F SN21567, a full revolution mechanical power press, and  correct operating procedures were not being followed in that the operators used the punch press with a barrier guard not present, exposing employees to caught in hazards.
