29 CFR 1910.132(d)(1) The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment:  a.) Wabtec Freight Rail, Inc, Building,  December 7, 2022 and times prior thereto: Using a crane, an employee removed a Stator with Roll Plate attached to it from a 170 degrees Celsius oven. Due to a misconfiguration of the part when assembled, while removing the bolts and screws that attached roll plates to the stator, the plate fell on the employee. A hazard assessment had been completed and the hazard of contact with the hot object was identified, but employer did not select and require Personal Protective Equipment designed to prevent thermal burns to the lower body, or otherwise implement a control to prevent against such contact, due to the unforeseen nature of incident. The employee sustained a second degree burn to the leg.  b.) Wabtec Freight Rail, Inc, Building 6, 12/15/22 and times prior thereto: Employees in the Vacuum Pressure Impregnation (VPI) process were observed working without proper personal protective equipment for the thermal hazards presented by equipment including but not limited to, the roll plates and stators that were removed from the 170 degrees Celsius oven.  Employees were noted to be wearing short sleeve shirts and standard workwear shirts with no thermal protective properties. (Deleted)  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
