29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposed an employee to injury, was not guarded: a.) On or about 12/19/2022, in the Fabrication Yard, employees operated a Scotchman Machine Model DO/100/24M, Serial 1052M1097 to bend, cut and punch metal, that was not equipped with a guard at the point of operation. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.212(a)(3)(iii): Special hand tools for placing and removing material(s) was not provided to permit easy handling of material without the operator placing a hand in the danger zone: a.) On or about 12/19/2022, in the Fabrication Yard, employees operated a Scotchman Machine Model DO/100/24M, Serial 1052M1097 to bend, cut and punch metal, and the employer had not provided tools for employees to use to place or handle the pieces of metal that they were to bend, cut and/or punch. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
