29 CFR  1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  a.) Mix Plant - On or about December 13, 2022, the employer did not ensure that an energy control program, which included periodic inspections, was established for employees performing service and maintenance on Mix Plant machines, including Line 1-4 Augers, Mixers, Sifters, Airlocks and Blower, thereby exposing employees to hazards associated with rotating and moving parts.

Mix Plant - On or about December 13, 2022, authorized employees performed servicing and/or maintenance on the Line 3 Mixer.  The employer did not ensure that periodic inspections of the energy control procedures were performed at least annually as required by the standard.

29 CFR  1910.147(c)(8): Lockout or tagout was not performed only by the authorized employees who are performing the servicing or maintenance:  a.) Mix Plant - On or about December 13, 2022, the employer failed to ensure that the authorized employee performing service and maintenance on the Line 3 Mixer, locked out the machine. The authorized employee was exposed to unexpected energizing, start up, or release of stored energy, when another authorized employee not performing the work locked out the machine on the employee's behalf.

29 CFR  1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):  a.)  Mix Plant - On or about December 13, 2022, an employee was exposed to machine hazards associated with rotating and moving parts while unjamming product in the Line 4 hopper.  The employer failed to implement energy control application steps as the machine was not shut down or turned off to perform the servicing work [per the 1910.147(d)(2) requirements].  As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)((i)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards.
