29 CFR  1910.25(c)(1): The employer did not ensure that standard stairs are installed at angles between 30 to 50 degrees from the horizontal.  a. Ultimate RB, Inc. - Delphos, Ohio: On or about December 20, 2022, employees were exposed to trip and fall hazards in that the two sets of stairs, used to access the platform at Press 1, were installed at an angle of approximately 62 degrees each.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR  1910.178(a)(4):Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals were not changed accordingly:  a. Ultimate RB, Inc. - Delphos, Ohio: On or about December 12, 2022, the employer did not obtain approval from the forklift manufacturer before modifying the length of the forks to 90-inches on the Nissan forklift (model P502A25PV; s/n PJ02-9H6263). Employees that used the forklift for tasks such as, but not limited to, removing press platens, were exposed to tip-over hazards in that modifications and additions affect the safe operation of the truck.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR  1910.184(c)(6): Slings were not securely attached to their loads:  a. Ultimate RB, Inc. - Delphos, Ohio: On or about December 13, 2022, the employer did not ensure that lifting devices were securely attached to the load.  Employees that used a 2-legged chain sling and two nylon slings to lift a press mold weighing approximately 2,500 pounds were exposed to struck-by hazards.  The nylon slings were not attached to the load in a manner that would prevent the material from being displaced, resulting in an employee being struck by the platen.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. Ultimate RB, Inc. - Delphos, Ohio: On or about December 20, 2022, the employer did not ensure that employees working at Press 1 were protected from pinch point hazards created between the filler box and mold as the filler box was lowered by the press head onto the mold.  b. Ultimate RB, Inc. - Delphos, Ohio: On or about December 20, 2022, the employer did not ensure that employees who operated Press 1 were protected from pinch point hazards created between the press head and filler box as the press head lowered into a mold.  c. Ultimate RB, Inc. - Delphos, Ohio: On or about December 20, 2022, employees who assisted in inserting pins into molds at Press 1 were exposed to pinch points in that a pin can be inserted during a time the press head continues to lower.    d. Ultimate RB, Inc. - Delphos, Ohio: On or about December 20, 2022, employees who worked at Press 1 to fill and prep molds were exposed to caught-in hazards in that the auger which dumps material into the mold was not guarded.
