29 CFR 1910.146(g)(1): The employer did not provide training so that all employees whose work was regulated by 29 CFR 1910.146 (permit required confined spaces) acquired the understanding, knowledge, and skills necessary for the safe performance of the duties assigned under 29 CFR 1910.146: 1.) On or about January 16, 2019, the employer did not assure each employee that was required to enter a permit required confined space was trained with the knowledge and skills necessary to safely perform entry of a permit required confined space. Employees tasked with cleaning the mixers have not received training on proper permit confined space procedures including but not limited to; the proper procedure of alerting local rescue services if a rescue is necessary.

29 CFR 1910.146(k)(1): An employer who designates rescue and emergency services, pursuant to paragraph (d)(9)of this section did not evaluate the prospective rescuer's ability by the criteria set in this section, (k)(1)(i) - (k)(1)(v). 1.) On or about January 16, 2019, The employer did not evaluate the prospective rescuer's ability to perform the required rescue procedures. The employer did not contact the Delphos Fire Department and evaluate their ability to respond to a rescue situation with the proper equipment for the various hazards they may encounter, their ability to respond in a timely manner, or give access to the areas so that the rescue service can develop an appropriate plan.
