29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2m) or more above a lower level was protected from falling by guardrail systems, safety net system, or personal fall arrest system:  a) Kit Kat Line 22, Chocolate Depositor - Employees worked from the top of the chocolate depositor to perform cleaning operations at a height of 6 feet - 6 inches above the floor and were not provided with fall protection, on or about December 21, 2022.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1910.29(b)(13): When guardrail systems are used around holes that serve as points of access (such as ladderways), the guardrail system opening did not meet the requirements (b)(13)(i) or (b)(13)(ii) of this section:  a) Kit Kat Line 24, Motorman Elevator - The elevated platform did not have a self-closing gate that slides or swings away from the ladderway and was not offset so that an employee could not walk or fall into the opening while working on the platform, on or about December 21, 2022.  No abatement certification or documentation required.

The cooling tunnel contains multiple levels of conveyor belt exposing employees to caught-in and/or struck-by hazards.   Abatement certification required within 10 days after abatement date. 29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  a) Kit Kat Line 22, Moulding Area - The guarding around the nip point created by the conveyor chain into the cooling tunnel was inadequate because the guard could be bypassed while the conveyor was running, on or about December 21, 2022.  b) Kit Kat Line 22, Moulding Area - The nip points created by the conveyor chains at the discharge side of the chocolate depositor were not guarded, on or about December 21, 2022.  Abatement certification required within 10 days after abatement date. 29 CFR 1910.303(g)(1): Sufficient access and working space was not provided and maintained about all electric equipment (operating at 600 volts, nominal, or less to ground) to permit ready and safe operation and maintenance of such equipment:  a) Kit Kat Line 22, Moulding Area - An HMI 110vac/480vac electrical control panel was blocked by a rolling lift cart and was not readily accessible, on or about December 21, 2022.  b) Area Between Kit Kat Line 22 and Old Caramel Room - Two 480vac electrical panels were blocked by yellow rolling totes and were not readily accessible, on or about December 21, 2022.  c) Line 23 - A 480vac electrical panel was blocked by rolling tool cabinets and were not readily accessible, on or about December 21, 2022.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
