29 CFR 1910.28(b)(11)(i): The employer did not ensure that each employee exposed to an unprotected side or edge of a stairway landing that is 4 feet (1.2 m) or more above a lower level is protected by a guardrail or stair rail system.  a)  On or about January 4, 2023, employees were exposed to falls of four feet  and five inched from a stairway, located in the loading dock that was not protected with a guardrail or handrail system.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1910.37(a)(3):  The employer did not ensure that exit routes must be free and unobstructed. No materials or equipment may be placed, either permanently or temporarily, within the exit route. The exit access must not go through a room that can be locked, such as a bathroom, to reach an exit or exit discharge, nor may it lead into a dead-end corridor. Stairs or a ramp must be provided where the exit route is not substantially level.  a) On or about December 28, 2022, the emergency exit located behind the bailing machine was blocked by stacked plastic recyclable material and debris which prevented employees from utilizing the exit in the event of fire or emergency.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR  1910.147(c)(4)(i):  Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section.   a)  On or about December 28, 2022,  the employer did not develop, document or utilize procedures that were specific to the equipment such as the Pallet Dismantlers and clearly outlined the following: a specific statement of the intended use of the procedure (servicing, maintenance, and/or un-jamming), procedural steps for shutting down, isolating and securing the machine to control hazardous energy (electrical, and pneumatic), procedural steps for the placement, removal and transfer of lockout devices or tagout devices and the responsibility for them, and specific requirements for testing the machine to determine and verify the effectiveness of the lockout devices, tagout devices and other energy control measures.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR  1910.219(c)(2)(i):  All exposed parts of horizontal shafting seven (7) feet or less from floor or working platform, excepting runways used exclusively for oiling, or running adjustments, were not protected by a stationary casing enclosing shafting completely or by a trough enclosing sides and top or sides and bottom of shafting as location requires.  a) On or about December 28, 2022,  the employer did not ensure that the two (blue) pallet dismantlers, RC-1105-11 and R8-1133-06,  that had exposed spinning shafts, were protected by stationary casing or any guarding enclosing the shafting completely.
