29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition shall be removed from service. All repairs shall be made by authorized personnel. a. On or about December 30, 2022, the employer failed to remove the Toyota propane-powered industrial truck (Model 8FGU15, SN 31757) from service when in an unsafe operating condition. A piece of rolled cardboard was used to replace a pin used to hold the propane tank.

29 CFR 1910.178(q)(5):All parts of any such industrial truck requiring replacement shall be replaced only by parts equivalent as to safety with those used in the original design. a. On or about December 30, 2022, the employer failed to use equivalent parts to replace a missing pin. A pin which supported the mount for the propane tank on the Toyota propane-powered industrial truck (Model 8FGU15, SN 31757) had been replaced by a roll of cardboard.
