29 CFR 1960.8(a): The Agency head did not furnish employment and a place of employment to each employee that were free from recognized hazards that caused or were likely to cause death or serious physical harm to employees in that they were exposed to vehicular stuck-by hazards: BORDER PATROL TUCSON SECTOR INTEL UNIT, STATE ROUTE 80 CHECKPOINT: The Border Patrol failed to ensure all necessary temporary traffic control signs were in place, exposing employees to struck-by hazards from motor vehicles. On December 10, 2022, a Border Patrol Agent was hospitalized after being struck by a motorcycle.

29 CFR 1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation, or the loss of an eye. BORDER PATROL TUCSON SECTOR 2430 S SWAN ROAD, TUCSON, AZ 85711: On or about December 10th, 2022, the employer failed to report the in-patient hospitalization of an employee who was struck by a motorcycle while inspecting vehicles at State Route 80 Checkpoint. A report of the incident was not received by OSHA until December 12th, 2022. The U.S. Border Patrol was previously cited within OSHA's Region IX for a violation of this occupational safety and health standard, which was contained in OSHA Inspection #1626583, Notice #2, Item #1, which became final order on December 28, 2022.
