29 CFR 1910.37(b)(5): Each doorway or passage along an exit access that could be mistaken for an exit was not marked "Not an Exit" or similar designation, or be identified by a sign indicating its actual use (e.g. closet):   a) On or about 01/04/2023, in the Main warehouse on 3901 Genesee St; Employees were exposed to fire hazards when a door at the end of aisle four was illuminated "EXIT" but lead into a shared hallway. The employer did not ensure the door was marked "Not an Exit" to prevent the use of the door in the event of an emergency.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.176(b): Material stored in tiers was not stacked, blocked, interlocked or limited in height so that it was stable and secure against sliding and collapse:  a) On or about 01/04/2023, in Aisle 7 of the Airport Warehouse at 4039 Genesee St.; employees were exposed to crushing hazards when materials such as but not limited to; a 5-drawer lateral file approximately 66 inches in height and 175 pounds was stored upright and unsecure on the top level of the storage rack. Long, tall, or top-heavy items should be stored on their side at a lower level and secured to prevent tip over.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:   a) On or about 01/04/2023; in the establishment, employees were exposed to struck by hazards when the employer did not ensure all Powered Industrial Vehicle (PIV) operators with prior experience, were evaluated at least once every three years. Last evaluations expired May 2015.  Employees operate PIVs such as, but not limited to, Raymond 440 C35 serial number 440-07-10139 and Mitsubishi FB16NT serial number EFB1200150 to move materials throughout the facility.    ABATEMENT CERTIFICATION REQUIRED
