29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a.  On or about January 4, 2023, at the above addressed jobsite, the portable ladder used to access and egress the first second story of the structure was not extended at least three (3) feet above the upper landing surface, thereby exposing the employees to fall hazards.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a.  On or about January 4, 2023, at the above addressed jobsite, an employee performing residential carpentry operations, twenty (20) feet eight (8) inches above ground, was not protected from falls, thereby exposing the employee to fall hazards.  b.  On or about January 4, 2023, at the above addressed jobsite, an employee performing residential carpentry operations, eight (8) feet six (6) inches above a lower level, was not protected from falls, thereby exposing the employee to fall hazards.  c.  On or about January 4, 2023, at the above addressed jobsite, employees performing residential carpentry operations near an unguarded wall opening, thirteen (13) feet nine (9) inches above ground, were not protected from falls, thereby exposing the employees to fall hazards.  United Custom Homes, LLC was previously cited for a violation of this occupational safety and health standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1504208, citation number 2, item number 1, and was affirmed as a final order on March 5, 2021, with respect to a workplace located at 835 Santa Maria Dr. in Naperville, Illinois.
