29 CFR 1926.451(h)(1):Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects. For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall. On or about January 6, 2023 the employer KCS Contracting, LLC at jobsite located at 5685 Benore Rd. Toledo OH 43612 failed to ensure the components of the tubular scaffolding system used by employees onsite, were inspected by a competent person prior to each shift for visual defects such as cracks and defects in the planking. Four employees working from the tubular scaffolding were exposed to struck by hazards from lack of toeboards, screens, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect falling objects.

29 CFR 1926.501(b)(14):Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system. On or about January 6, 2023 the employer KCS Contracting, LLC, at worksite located at 5685 Benore Rd., Toledo, OH 43612, did not ensure employees were protected from falls, in that employees were exposed to falls through wall openings, 13 feet from the second level and 23 feet from the third level to the ground below, while throwing trash and debris out windows of the commercial hotel building.

On or about January 6, 2023 the employer KCS Contracting, LLC at jobsite located at 5685 Benore Rd. Toledo OH 43612, did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls during job site operations, decreasing the probability of employee injury or illness. KCS Contracting, LLC, was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.454(a) which was contained in OSHA inspection number 1298817, citation number 1, item number 1b, and was affirmed as a final order on May 14, 2018, with respect to a workplace located at 1458 Spring Meadows Drive, Holland, OH 43528.
