29 CFR  1910.1025(h)(1):Surfaces. All surfaces were not maintained as free as practicable of accumulations of lead.  a) The employer did not ensure that all surfaces were maintained as free as practicable of accumulations of lead.  Wipe samples collected on January 19, 2023 from multiple locations, including station 534 jigs 1, 2, 3, and the work center soldering station six indicated the presence of lead ranging from 146.09 to 7,487 micrograms.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.1025(m)(1)(i): The employer did not comply with all requirements of the Hazard Communication Standard (HCS) (� 1910.1200) for lead.  a) On or about January 11, 2023, Xylem Water Solutions did not comply with all the requirements of the Hazard Communication Standard � 1910.1200 for lead. Employees had a potential exposure to lead when performing soldering operations.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1910.1025(m)(1)(iii): The employer did not include lead in the hazard communication program established to comply with the HCS (� 1910.1200), and the employer did not ensure that each employee had access to labels on containers of lead and to safety data sheets, and that employees were trained on lead in accordance with the requirements of HCS and paragraph (l) of this section.  a) On or about January 11, 2023, Xylem Water Solutions did not include lead in their hazard communication program established to comply with the HCS (� 1910.1200).  The employer did not provide training to employees regarding the hazards associated with lead.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR  1904.41(a)(1):Annual electronic submission of part 1904 records by establishments with 250 or more employees. If your establishment had 250 or more employees at any time during the previous calendar year, and this part requires your establishment to keep records, then you must electronically submit information from the three recordkeeping forms that you keep under this part (OSHA Form 300A Summary of Work-Related Injuries and Illnesses, OSHA Form 300 Log of Work-Related Injuries and Illnesses, and OSHA Form 301 Injury and Illness Incident Report) to OSHA or OSHA's designee. You must submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the forms.  a) On or about May 1, 2023,  the employer failed to electronically submit information from their OSHA Form 300A or equivalent for calendar year 2022 by March 2, 2023. The establishment employed 560 employees and was classified with NAICS code 333914 during calendar year 2022.
