29 CFR 1910.146(d)(3)(i): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations, including specifying acceptable entry conditions: (a) On January 11, 2023, the employer failed to adequately specify acceptable entry conditions of a permit space. While performing Confined Space Rescue Training in building 1 the employer failed to ensure the manway entrance was large enough for all employees directed to enter.

29 CFR 1910.146(k)(2)(i): Employer did not provide affected employees with the personal protective equipment (PPE) needed to conduct permit space rescues safely: (a) On or before 1/11/2023 the employer did not provide adequate PPE required for safe rescue from a confined space. The rescue harness and self-retracting lifeline provided were underrated for the intended user.
