29 CFR 1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person: (a)Miranda Framing at 7400 East Oak Grove Trail, Sioux Falls, SD 57110: On or about and at times prior to January 12, 2023, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were conducting framing operations on a commercial property without the use of a fall protection system in place and improper use of ladders. This condition exposed employees to fall hazards of greater than six feet.

29 CFR 1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: (a)Miranda Framing at 7400 East Oak Grove Trail, Sioux Falls, SD 57110: On or about and at times prior to January 12, 2023, the exposing employer did not ensure that employees were protected from falls while conducting framing operations on a commercial property. This condition exposed employees to fall hazards greater than six feet. Miranda Framing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 1606364, citation number 1, item number 1, and was affirmed as a final order on September 23, 2022, with respect to a workplace located at 22nd Street & South Ellis Road, Sioux Falls, SD 57104.

Miranda Framing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(13), which was contained in OSHA inspection number 1606364, citation number 1, item number 2, and was affirmed as a final order on September 23, 2022, with respect to a workplace located at 22nd Street & South Ellis Road, Sioux Falls, SD 57104.
