The employer shall provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees. The training shall include the following: Each affected employee shall be instructed in the purpose and use of the energy control procedure. a) On or about January 9, 2023, Kyocera Senco Industrial Tools, INC did not ensure affected employees were instructed in the purpose and use of the energy control procedure, in that employees are required to work in an area and use machines in which servicing and maintenance is done under lockout or tagout.

29 CFR 1910.212(a)(1): Machine guarding. Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc. a) On or about January 9, 2023, the employer did not provide machine guarding to protect employees from hazards created by ingoing nip point in that the auger on the Lamson Dust Collector Serial Number 881659 was not guarded. b) On or about January 13, 2023, the employer attempt to provide machine guarding to protect employees from hazards created by ingoing nip point in that the guard for the auger located on the dust collector Lansom 2 was not adequate in that employees were exposed to the point of operation due to the guard opening being 3 ? inches. c) On or about January 23, 2023 the employer did not use one or more methods of machine guarding for equipment such as but not limited to; the CB Nelson Staple Machine numbers 3015, 3020, and 3029 in that employees were exposed to a nip point hazards due to the point of operation is located 4" away from the glue dispenser.

The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative. a) On or about January 13, 2023, Kyocera Senco Industrial Tools Inc's energy control program was not adequate in that affected employees were identified as employees who can perform servicing or maintenance on a machines or equipment with hazardous energy.
