29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. On or about January 13, 2023, the employer did not take Yale forklift Serial number: G807N12448S out of service when the headlights, 3ft light curtain, flashing lights and handle on right rear overhead guard post were not working properly and were in need of repair.
