OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Employees were engaged in material handling activities at the facility located at 600 East 39th Street, Hastings, Nebraska were exposed to crushing and struck-by hazards in that the employees were operating and working in close proximity to powered industrial equipment that operated in Room 6 near metal storage racks that did not have impact protection at the ends of the aisles. AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE ABATEMENT METHODS TO CORRECT THIS HAZARD ARE: 1) Install impact protection at the ends of aisles to prevent racking uprights from being struck. 2) Train employees to recognize the dangers and to evaluate any hazards in regard to striking racking uprights. 3) Develop a process where employees can report damaged racking and the racking is replaced in a timely manner.

29 CFR 1910.119(d)(3)(ii): The employer did not document that equipment complies with recognized and generally accepted good engineering practices: Employees engaged in production activities at 600 East 39th Street, Hastings, Nebraska on or about January 13, 2023, were exposed to chemical hazards in that the employer did not document that it complied with recognized and generally accepted good engineering practice (RAGAGEP), such as ANSI/IIAR 2; ANSI/ASH RAE Standard 15-1994; and IIAR Bulletin 109, Section 4.7.6, when it did not ensure that ammonia refrigeration piping in Room 1 and Room 4 were labeled.
