29 CFR 1910.28(b)(1)(i):29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): a) Blending Department: On January 11, 2023, and at times prior, the employer exposed employees to fall hazards of approximately 7 feet, 7 inches, in that the employer did not ensure that the guardrails of the platform around the mask tank extended across all of its unprotected sides as employees accessed the platform to monitor the condition of the tank's chemical contents.

29 CFR 1910.147(c)(4)(i):Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: a) Wick Processing Department: On January 13, 2023, and at times prior, employer exposed employees to burn hazards from contact with temperatures of up to 263 degrees F, in that the employer did not develop and require employees to utilize energy-isolating procedures before entering vacuum oven of the Flux Machine to perform maintenance activities such as correcting wires that have become tangled or broken inside the equipment.

One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. a) Wick Winding Department: On January 13, 2023, and at times prior, the employer exposed employees to amputation hazards, in that the light curtains installed on the wick winding machines are not sufficient for preventing the clamping mechanism from closing while the operator inserts their hand near the point of operation to place or remove wire bobbins.

29 CFR 1910.303(b)(2): Listed or labeled electrical equipment was not used or installed in accordance with instructions included in the listing or labeling: a) Wick Winding Department: On January 11, 2023, and at times prior, the employer exposed employees to electrical fire hazards, in that two power strips were connected to one another in order to supply power to equipment in the area, including the labeling machine at the center of the department as employees operate the machine. b) Wick Winding Department: On January 11, 2023, and at times prior, employer exposed employees to fire and electrical shock hazards, in that the employer did not mount the metal electrical box powering the Labeling/Sealing Machine to a secure surface, instead using it as a pendant drop outlet box hanging above the machine as employees operate it. c) Wick Winding Department: On January 11, 2023, and at times prior, the employer exposed employees to fire and electrical shock hazards, in that the employer did not mount the metal electrical box powering the Little David case sealer machine to a secure surface as employees operate the equipment.
