29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation. a) Trench in the middle of the street in front of 90 8th Avenue: On or about January 16, 2023: Employees were using a pump to remove water in a trench which there was water accumulation from a water pipe break. An employee went into the trench to clear the pump of mud when it was clogged, and he was struck by caved-in street pavement. Adequate precautions had not been taken to protect employees against the hazards posed by water accumulation.
