29 CFR  1926.20(b)(1):The employer did not initiate and maintain such programs as may be necessary to comply with this part.  a)	Victor Jimenez  on or about January 18, 2023 at the address of 5832 County Rd. 1-2 Swanton OH, 43558: The employer did not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls during job site operations, decreasing the probability of employee injury and/or illness.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) Victor Jimenez  on or about January 18, 2023 at the address of 5832 County Rd. 1-2 Swanton OH, 43558: The employer did not ensure that employees had been trained in the appropriate use of fall protection such as but not limited to the use of personal fall arrest systems or alternative measures while performing roofing operations from elevated surfaces greater than six feet from the level below.

29 CFR  1926.416(a)(1):Employees were permitted to work in proximity to electric power circuits and were not protected against electric shock by de-energizing and grounding the circuits or effectively guarding the circuits by insulation or other means:  a)  Victor Jimenez on or about January 18, 2023 at the address of 5832 County Rd. 1-2 Swanton OH, 43558: The employer did not ensure employees were effectively protected from live conductors of an energized electrical service line by means of deenergization, insulation or proximity guarding during roofing work activities. Employees removing roofing shingles within arm's length of the 120V/220V energized electrical service line were exposed to electrical shock/electrocution.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  Victor Jimenez on or about January 18, 2023, at the address of 5832 County Rd. 1-2 Swanton OH, 43558: The employer did not ensure employees were protected from falls while performing roofing work activities (tearing off old shingles) atop a single-story residential structure. Employees operating in this condition were exposed to falls of 9ft to the ground below.
