29 CFR 1910.146(c)(8): When an employer (host employer) arranges to have employees of another employer (contractor) perform work that involves permit space entry, the host employer did not comply with the requirements specified in section 1910.146(c)(8)(i) through (v): a) Baghouse, hopper; On or about November 16, 2022 and at times prior to the host employer Sander's Lead Company, Inc contracted the general contractor AHR Metals, Inc to provide employees to conduct welding work inside of a permit required confined space without first evaluating the confined space program and permit required entry procedures of AHR Metals.

29 CFR 1910.212(a)(1):One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a) Slag department, hopper outfeed conveyor; On or about January 18, 2023 and at times prior to the employer exposed employees to amputation hazards in that employees were working around the hopper with guards that have been removed surrounding rotating shafts.
