29 CFR 1910.134(c)(2)(ii): The employer did not establish or implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator: On or about January 19, 2023, and at times prior thereto, the employer did not provide a medical evaluation to determine each employee's ability to use a respirator before allowing their voluntary use. McCorvey Sheet Metal Works, L.P. was previously cited for a violation of this or similar Occupational Safety and Health Standard 29 CFR 1910.134(e)(1), which was contained in OSHA inspection number 1612758, citation number 1 item number 1 and was affirmed as a final order on November 18, 2022, with respect to a workplace located at 8610 Wallisville Rd, Houston, TX 77029.
