Building 750 MHE Bay - On or about March 15, 2023, the employer had in excess of 3 flammable storage lockers within the bay which is in excess to the quantity designated in DLAR 4145.11 enclosure 6, and NFPA 30 14.5.4.   c. Building 750 Room 123 - On or about March 15, 2023, the employer had modified the flammable storage cabinet by drilling holes in the cabinet to affix a padlock device due to the handle not working any longer, by breaching the walls the employer compromised the fire rating as it was not reverified by UL to meet design criteria UL 1275.  d. Building 750 HVAC Shop - On or about March 9, 2023, the employer had modified the flammable storage cabinet by drilling holes in the cabinet to affix a padlock device however part of that had fallen off or been removed leaving 4 open holes in the door wall. The modifications were due to the handle not working any longer, by breaching the walls the employer compromised the fire rating as it was not reverified by UL to meet design criteria UL 1275.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1960.8(a):  The Agency head did not furnish employment and a place of employment to each employee that were free from recognized hazards that caused or were likely to cause death or serious physical harm from struck by hazards associated with metal racking.  a. Building 83 - The agency failed to ensure pallet racks were marked for capacity in accordance with MH16.1 and DLA Distribution Manual 6055.01 (dated 10/20/17). Capacity ratings were illegible due to being covered by stickers, on or about March 9, 2023.  b. Building 750 MHE Bay - On or about March 15, 2023, the racks located near the door to the hall back into the building were not anchored, in addition the racks were not on even flooring which resulted in one end being propped up with red brick.   c. Building 750 MHE Supply Room - On or about March 15, 2023, racks in rows, c, d, e, f, g were not anchored to the floor in accordance with MH16.1.  d. Building 750 MHE Supply Room - On or about March 15, 2023, the rack system used for belts in row H were not anchored to the floor in accordance with MH16.1. additionally, there were movable shelf racks that did not have the locking pin/safety pin mechanism engaged.   e Building 750 MHE Supply Room "toilet" area - On or about March 15, 2023, the movable shelf racks that did not have the locking pin/safety pin mechanism engaged in accordance with MH16.1.  f. Building 750 Roads and Grounds - On or about March 15, 2023, the de-icer storage rack had a damaged upright, the employer continued to use the rack instead of taking it out of service for repair in accordance with MH16.1 and DLA Distribution Manual 6055.01 (dated 10/20/17).  g. Building 750 Carpentry - On or about March 9, 2023, the plywood rack did not have the locking pin/safety pin in place on the 2nd and 4th tier in accordance with MH16.1.  h. Building 87 - On or about March 9, 2023, location 87130818A upright was damaged at the base of the structural metal movable shelf rack, was not taken out of service for repair in accordance with MH16.1 and DLA Distribution Manual 6055.01 (dated 10/20/17).  i. Building 87 - On or about March 9, 2023, location 87131305B the movable shelf racks that did not have the locking pin/safety pin mechanism engaged in accordance with MH16.1.  j. Building 87 - On or about March 9, 2023, location 87170909 upright was damaged at the base of the structural metal movable shelf rack, was not taken out of service for repair in accordance with MH16.1 and DLA Distribution Manual 6055.01 (dated 10/20/17).  k. Building 87 - On or about March 9, 2023, location 6A12192C the adjustable shelf rack cross braces were not set into place and locked into place to prevent dislodgement and collapse were not maintained and installed in accordance with MH16.1.

29 CFR 1960.8(c): The Agency did not develop, implement, and evaluate an occupational safety and health program in accordance with the requirements of section 19 of the Act, Executive Order 12196, and the basic program elements prescribed in this part, or approved alternate program elements:  a) Building 50, Row 338 - The agency failed to ensure that empty stacking frames were pulled and placed in a proper designated stacking frame storage area, in accordance with DLA Distribution Manual 6055.01 (dated 10/20/17). An empty stacking frame was observed between the 2nd and 4th stacking frame tiers, on or about March 23, 2023.  b) Building 50, Bay 2, 50124632 - The agency failed to ensure that stacking frames showing visible damage were removed from service and tagged, "Do Not Use" in accordance with DLA Distribution Manual 6055.01 (dated 10/20/17). The upright at the base of the rack was bent and twisted exposing employees to struck-by hazards, on or about March 23, 2023.  c) Building 53, Bay 3, 3-08 - The agency failed to ensure that stacking frames showing visible damage were removed from service and tagged, "Do Not Use" in accordance with DLA Distribution Manual 6055.01 (dated 10/20/17). The upright at the base of the rack was bent and the frame was out of plumb exposing employees to struck-by hazards, on or about March 23, 2023.  d) Building 56, Bay 1, Rack 08 - The agency failed to ensure that stacking frames showing visible damage were removed from service and tagged, "Do Not Use" in accordance with DLA Distribution Manual 6055.01 (dated 10/20/17). The upright at the base of the rack was bent and twisted exposing employees to struck-by hazards, on or about April 19, 2023.  e) Building 760, Aisle 02, Rack 6020246A1 - The agency failed to ensure that stacking frames showing visible damage were removed from service and tagged, "Do Not Use" in accordance with DLA Distribution Manual 6055.01 (dated 10/20/17).
