29 CFR  1926.1052(c)(6):The height of handrails was greater than 37 inches (94 cm) from the upper surface of the handrail to the surface of the tread in line with the face of the riser at the forward edge of the tread: 3000 Meadows Dr. Sterling, MA 01564: On or about January 26, 2023, employees were exposed to fall hazards when using the first-floor stairwell due to the top rail measuring  55 inches high from the surface of the tread to the upper surface of the handrail.  This was a temporarily installed handrail to allow workers access to the second floor of the worksite.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b) 3000 Meadows Dr. Sterling, MA 01564: On or about January 26, 2023, an employee was exposed to fall hazards of approximately 6 feet 8 inches above a lower level while performing residential construction work. This work placed the employee at risk of a fall greater than 6 feet and no fall protection system was in place.  Yanez Framing Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1478439, citation number 1, item 1a, and was affirmed as a final order on September 18, 2020, with respect to a workplace located at Leominster Rd. Sterling, MA 01564.  Yanez Framing Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1522968, citation number 2, item 1, and was affirmed as a final order on August 3, 2021, with respect to a workplace located at Jaffrey Rd. Lot 7/33-2, Marlborough NH 03455.
