Location: 3 Aston Court, Andover, MA;  On or about 03/17/2023, the employer did not ensure that each employee who utilized a rough terrain forklift had received training which included formal instruction, practical (hands on) training and an evaluation with a written certification of completion.

29 CFR 1926.602(c)(1)(vi): Section 603(e) of American National Standard Institute, B56.1-1969 Safety Standards for Powered Industrial Trucks, as adopted by 29 CFR 1926.602(c)(1)(vi): When a truck was left unattended, load engaging means were not fully lowered, controls were not neutralized, power was not shut off, brakes were not set, and the key or connector plug was not removed.  Location: 3 Aston Court, Andover, MA;  On or about 03/17/2023, the Lull, Model# 944E-42, Serial# 0160007295, was left unattended with the load suspended at a 2nd story window of the residence over the opening for the 2-car garage where employees were witnessed walking and working in the vicinity of the suspended load.

Location: 3 Aston Court, Andover, MA;  On or about 03/17/2023, the foreman was witnessed accessing an upper level with a portable extension ladder which did not extend 3-feet above the surface which he was gaining access to.  Yanez Framing Inc. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1478439, citation number 1, item number 1-b and was affirmed as a final order on 02/09/2021, with respect to a workplace located at Northgate Meadows Subdivision, Leominster Road, Leominster, MA 01564.
