29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets. On or about 1/27/2023, at 531 SE Walters Terrace, Port Saint Lucie, Florida, employees were working at a single family residential new construction site and were exposed to overhead struck-by hazards without the use of personal protective equipment (PPE) when a crane was moving trusses over laborers without hard hats.

29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): On or about 01/27/2023, at 531 SE Walters Terrace, Port Saint Lucie, Florida, employees were engaged in flying trusses onto a new residential construction and were not using any means of fall protection system while exposed to a 8-foot fall hazard. MCRUZ Construction INC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1573384, citation number 2, item number 1 and was affirmed as a final order on 02/14/2022, with respect to a workplace located at 1758 SW Nantucket Ave. in Port Saint Lucie, Florida.
