29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: Wood cutting area: On or about January 25, 2023 and at times prior thereto, woodcutters performing woodcutting operations were exposed to continuous noise at a dose of 69.5% (8-Hour Time Weighted Average sound level of 85 dBA) during the 507 minute sampling period. For a full eight-hour work shift, this exposure is equivalent to an average sound level of 87.3 dBA.

29 CFR 1910.95(i)(2):The employer did not ensure that hearing protectors were worn by employees whose exposures equaled or exceeded an 8-hour time-weighted average of 85 decibels: 906 Ruiz, San Antonio TX; woodcutting area: On or about January 25, 2023 and at times prior thereto, workers performing woodcutting were exposed to hazardous noise exceeding an 8-hour time-weighted average of 85 decibels and were not required by the employer to wear hearing protectors in the hazardous noise environment.
