29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: (a) On or about January 27, 2023, and days prior, the employer did not develop and implement a hazardous energy control program for employees or contractors to utilize who perform maintenance and cleaning on, but not limited to stoves, ovens, grills and other restaurant food preparation equipment and ventilation equipment. This exposed employees to unexpected energizing, start-up or release of stored energy, gases or other mechanical process.

29 CFR 1910.147(f)(2)(i): When outside servicing personnel were engaged in activities in a facility, the onsite employer and the outside employer did not inform each other of their respective lockout or tagout procedures. (a) On or about January 26, 2023, the host employer and outside contractor did not inform and/or share respective lockout/tagout procedures prior to outside contractor's employees performing cleaning work on the ventilation system over grills. The gas to the grills were not isolated and locked out prior to performing the cleaning work, exposing employees to a fire and burn hazard.
