29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition. On or about 1/27/2023, SEMO Milling, LLC had not ensured that any powered industrial truck which was found in need of repair, defective, or in any way unsafe, was removed from service. The following forklifts were in use and not removed from service: a) Nissan Forklift 50, Model CHP02L25E. The forklift was defective at the time of the inspection; the accelerator pedal was missing pad; the paint was worn off and bare metal was exposed. Hydraulic fluid was leaking from the fork cylinder area. b) Nissan Forklift, Model CP1B2L25E. The forklift did not have labels identifying fork lever control functions.
