1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity): On January 27, 2023, at a worksite located at 1095 Regency Parkway, Saint Charles, Missouri, employees of Toenjes Brick Contracting, Inc. were performing masonry work from a supported scaffold. The Employees working on the scaffold were approximately 11.5 to 15.5 feet high without utilizing personal fall arrest system or guardrail system.

Note: The requirements applicable to construction work under this paragraph are identical to those set forth at 1910.178(l) of this chapter: 29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not conducted at least once every three years: On January 27, 2023, employees of Toenjes Brick Contracting, Inc. were operating a JCB 509-42 Telehandler at commercial building located at 1095 Regency Parkway, Saint Charles, Missouri. The employees were operating the telehandler to move brick, scaffold components, and mortar tub around the jobsite. The employer did not ensure that employee(s) operating the powered industrial truck were evaluated at least once every three years.
