29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a) Jobsite located at 843 N Beechwood St, Philadelphia, PA 19130 - On or about January 31, 2023, the employer did not ensure that each employee in an excavation was protected from cave-ins by an adequate protective system. Employees were performing underground utility repairs within the excavation measuring approximately 6.5 feet deep without the use of shoring or other protective system, thereby exposing employees to cave-in hazards.

29 CFR 1926.1053(b)(1): Where a portable ladder was used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. a) Jobsite located at 843 N Beechwood St, Philadelphia, PA 19130 - On or about January 31, 2023, the employer did not ensure the side rails of an 8-foot portable ladder used for access to an upper-level landing surface extended at least 3 feet above the upper landing surface being accessed. The ladder utilized for egress from the excavation extended approximately less than a foot above the excavation edge, thereby exposing employees to fall hazards.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. Jobsite located at 843 N Beechwood St, Philadelphia, PA 19130 - On or about January 31, 2023, the employer did not ensure daily inspections of excavations and the adjacent areas were made by the competent person. Employees were required to work in an uninspected excavation measuring approximately 6.5 feet deep to install new underground utility lines, thereby exposing employees to cave-in and struck-by hazards. Gessler Construction Co., Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.651(k)(1), which was contained in OSHA inspection number 1345136, citation number 1, item number 2, and was affirmed as a final order on 3/29/2019, with respect to a workplace located at W Courtland St & N 16th St Philadelphia, PA 19140.
