29 CFR  1926.1053(a)(2): Ladder rungs, cleats, and steps were not parallel, level, and uniformly spaced when the ladder was in position for use:  Location: 120-122 Fleming Avenue. Newark, NJ 07105  a) Job built ladder did not have uniformly spaced rungs.  Employees used a job build ladder where spaces between the rungs from top to bottom measured at 18 inches, 19 inches, 17 inches and 20 inches, respectively.   Violation observed on or around February 1st, 2023.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  Location: 120-122 Fleming Avenue. Newark, NJ  a) The ladder did not extend at least 3 feet above the landing surface. Employees used a job built ladder to access an unprotected work platform to climb second job built ladder that did not extend at least three feet above the landing surface.  Violation observed on or about February 1, 2023

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   Location: 120-122 Fleming Avenue. Newark, NJ 07105  a) The employer did not ensure that employees were protected from falls.  Employees engaged in residential framing activities worked at or near the edge, at heights greater than 6 feet and were not protected from falls by use of a personal fall arrest system or guardrail system.    Violation occurred on or around February 1, 2023  b) The employer did not ensure employees were protected from falls.  Employees engaged in residential framing activities used a job built wood ladder to access a work platform that was approximately 9-feet above the next lower level, that was not protected by guardrails and employees did not use any other means of fall protection.   Violation observed on or about February 1, 2023
