29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At 414 Wickman Ave, Lot 10 Stonehaven, Gulf Shores, Alabama:  On February 3, 2022; the employer allowed his employees to perform framing activities without fall protection exposing his employees to a fall hazard of up to 19 feet 3 inches to the ground below.  The Lucas Martinez  dba Lucas Martinez  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1587151, citation number 1, item number 1 and was affirmed as a final order on May 24, 2022 with respect to a workplace located at 10961 Native Dancer Way Lot 521 Jubilee Farms, Daphne, AL and in OSHA inspection number 1595621, citation number 1, item number 1 and was affirmed as a final order on September 7, 2022 with respect to a workplace located at 110679 Winning Corner Trail Lot 466, Daphne, AL and in OSHA inspection number 1620315, citation number 1, item number 1 and was affirmed as a final order on November 4, 2022 with respect to a workplace located at 10942 Animal Kingdom Way, Lot 634 Jubilee Farms, Daphne, Alabama.

29 CFR  1926.1053(b)(13): The top or top step of a stepladder was used as a step:(a) (LOCATION) (IDENTIFY SPECIFIC OPERATION(S) AND/OR CONDITIONS)  a)  At 414 Wickman Ave, Lot 10 Stonehaven, Gulf Shores, Alabama:  On February 3, 2022; the employer allowed his employees to use an a-frame ladder to gain access to the trusses and they used the top of the ladder as a step exposing his employees to a fall hazard of up to 9 feet 1 inch.  The Lucas Martinez dba Lucas Martinez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(13), which was contained in OSHA inspection number 1595621, citation number 1, item number 1and was affirmed as a final order on September 6, 2021, with respect to a workplace located at 10679 Winning Corner Trail Lot 466, Daphne, Alabama.
