29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  a)  At 27870 Montelucia Way, Lot 83 The Reserve  of Daphne, Daphne, Alabama:  On March 12, 2024; the employer allowed his employees to operate pneumatic nail guns without eye protection while performing framing activities exposing his employees to struck-by hazards.  The Lucas Martinez  dba Lucas Martinez  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1648083, citation number 1, item number 1 and was affirmed as a final order on April 14, 2023 with respect to a workplace located at 414 Wickman Avenue, Lot 10 Stonehaven, Gulf Shores, Alabama.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At 27870 Montelucia Way, Lot 83 The Reserve  of Daphne, Daphne, Alabama:  On march 12, 2024; the employer allowed his employees to perform framing activities without fall protection exposing his employees to a fall hazard of up to 19 feet 1 inch to the ground below.  The Lucas Martinez  dba Lucas Martinez  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1587151, citation number 1, item number 1 and was affirmed as a final order on May 24, 2022 with respect to a workplace located at 10961 Native Dancer Way Lot 521 Jubilee Farms, Daphne, AL and in OSHA inspection number 1595621, citation number 1, item number 1 and was affirmed as a final order on September 7, 2022 with respect to a workplace located at 110679 Winning Corner Trail Lot 466, Daphne, AL and in OSHA inspection number 1620315, citation number 1, item number 1 and was affirmed as a final order on November 4, 2022 with respect to a workplace located at 10942 Animal Kingdom Way, Lot 634 Jubilee Farms, Daphne, Alabama and in OSHA inspection number 1648083, citation number 2, item number 1 and was affirmed as a final order on April 14, 2023 with respect to a workplace located at 414 Wickman Avenue, Lot 10 Stonehaven, Gulf Shores, Alabama.
