29 CFR 1926.20(b)(4): The employer failed to permit only those employees qualified by training or experience to operate equipment and machinery.  On or about February 6, 2023, and at times prior thereto, employees used an aerial lift to install new siding without being trained on the equipment,  exposing the employees to the hazard of falling up to 19 feet to the ground below.

29 CFR  1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary.  On or about February 6, 2023, and at times prior thereto, an employee was working from a scaffold where there was a space of more than 1 inch wide between planks, exposing the employee to a fall hazard of approximately 13 feet.

On or about February 6, 2023, and at times prior thereto, employees used an aerial lift to install siding on the exterior of a children's daycare under construction without being attached to the boom basket, exposing the employees to a fall hazard of up to approximately 19 feet to the ground below.

29 CFR  1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  On or about February 6, 2023, and at times prior thereto, employees were working from a scaffold which was observed to have numerous hazards associated with proper erection procedures and hazards associated with working from heights, exposing the employees to the hazard of falling approximately 13 feet to the ground below.
