29 CFR 1926.150(a)(1):The employer shall be responsible for the development of a fire protection program to be followed throughout all phases of the construction and demolition work, and he shall provide for the firefighting equipment as specified in this subpart. As fire hazards occur, there shall be no delay in providing the necessary equipment. a) On or about 02/08/2023, at the Batavia Players, Main Street 56 Theater City Centre, located on 35 Main Street in Batavia, New York, the employer did not enforce fire protection safety by maintaining effective measures to prevent fire hazards. Employees were allowed to renovate existing space inside the City Centre, without a safe fire protection program to include fire extinguisher access and maintenance. NO ABATEMENT CERTIFICATION REQUIRED

Employees were allowed to renovate existing space inside the City Centre, without unobstructed access to a fire extinguisher. NO ABATEMENT CERTIFICATION REQUIRED

Employees were allowed to renovate existing space inside the City Centre, without a safe fire protection program to include easily visible and identifiable locations with signs displaying the location of fire extinguishers. Fire extinguishers were not mounted. NO ABATEMENT CERTIFICATION REQUIRED
