29 CFR 1910.28(b)(1)(iii)(A): When the employer can demonstrate that the use of fall protection systems is not feasible on the working side of a platform used at a loading rack, loading dock, or teeming platform,  work is done without a fall protection system when the work operation for which fall protection is infeasible is not in process.  On or about February 8, 2023 the employer did not ensure that effective fall protection measures were in place on loading racks when active loading was not in process. Employees work from the elevated work platforms which contain an open side for placement of product and material pallets. When active loading is not taking place employees are exposed to a fall hazard of 6- 6/1/2 feet to the ground below. The loading racks/ platforms are located in Kitchen #1 Raw Side.

29 CFR  1910.212(a)(1):One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:   a) On or about February 8, 2023 the employer did not ensure that effective machine guarding was in place on the line 9 peeler panel. Employees are exposed to the pinch point created by the pressing action of the automatic guide on the back side of the equipment. Round stock bars are in place as a form of guarding but are not effective in preventing employees from reaching the hazardous area.   b) On or about February 8, 2023 the employer did not ensure that effective machine guarding was in place on the line 10 peeler panel. Employees are exposed to the pinch point created by the pressing action of the automatic guide on the back side of the equipment. Round stock bars are in place as a form of guarding but are not effective in preventing employees from reaching the hazardous area.   c) On or about February 8, 2023 the employer did not ensure that effective machine guarding was in place on the line 9 peeler panel conveyor. Employees are exposed to the pinch point created on the exit portion of the highspeed conveyor where the conveyor meets the rotating shaft.   d) On or about February 8, 2023 the employer did not ensure that effective machine guarding was in place on the line 10 peeler panel conveyor. Employees are exposed to the pinch point created on the exit portion of the highspeed conveyor where the conveyor meets the rotating shaft.   e) On or about February 15, 2023 the employer did not ensure that effective machine guarding was in place on the sliced lunchmeat (line5) . Employees are exposed to the pinch point created when the product placement arm retracts to a downward position. Employees are exposed to the pinch point between the arm and the structure of the equipment.  f)  Line 4 Drake, Line 5 Drake, and Tipper Tie RS4204 guarding was inadequate.
