Condition observed on or about 02/08/23.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.1053(b)(15): Ladder(s) were not inspected by a competent person for visible defects on a periodic basis and/or after an occurrence that could have affected their safe use:   a- 261 90th Street, Stone Harbor NJ: Company worksite workers were exposed to fall hazards, in excess of 25 feet to the ground surface below, when utilizing damaged portable ladders and a shingle shuttle track (being used as a ladder).  These ladders contained broken rungs, damaged rungs, bent side rails, etc. at the time of and prior to the worksite inspection. These ladders had not been inspected by a competent person while at the worksite.  Condition observed on or about 02/08/23.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(21): Employees were not grasping the ladder with at least one hand when progressing up and/or down the ladder:  a- 261 90th Street, Stone Harbor NJ: On or about 02/08/23 a worker was exposed to fall hazards approximately 11 feet to the ground surface below when progressing down a ladder with one hand carrying a cardboard box.  As such this worker was unable to grasp the ladder with one hand  as they were progressing down the ladder.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
