29 CFR 1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. (a) A & Zach Construction, LLC located at Lot 148, 1207 Lakeforest Drive, Hebron, Ohio: On and preceding February 7, 2023, the employer failed to initiate and maintain a safety program such as but not limited to a fall protection program and a ladder safety program to ensure the identification and correction of common hazards employees were exposed to during residential construction.

29 CFR 1926.1053(b)(13):The top or top step of a stepladder shall not be used as a step. (a) A & Zach Construction, LLC located at Lot 148, 1207 Lakeforest Drive, Hebron, Ohio: On and preceding February 7, 2023, the employer did not ensure that employees did not use the top or top step of stepladders. Employees used a 6 foot stepladder for access/egress from the trusses using the top and top step, thereby being exposed to a 6-foot fall hazard.

29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. (a) A & Zach Construction, LLC located at Lot 148, 1207 Lakeforest Drive, Hebron, Ohio: On and preceding February 7, 2023, the employer did not ensure that employees engaged in residential construction activities 6 feet or more above lower level were protected from falls. Framers were installing floor joists and panels at heights that varied from 20-26 feet without the use of fall protection. This condition exposed employees to falls up to 26 feet. A & Zach Construction, LLC was previously cited for a Repeat violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1623589, citation number 1, item number 1, and was affirmed as a final order on October 27, 2022, with respect to a workplace located at 8210 Hot Springs Dr, Pickerington, OH 43147. A & Zach Construction, LLC. was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1429825, citation number 1, item number 1 and was affirmed as a final order on November 14, 2019, with respect to a workplace located at 8026 Finch Leaf Dr, Plain City, OH 43064.
