OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:  a) 941 South 2nd Street, Camden, NJ - On or about February 1, 2023 employees were exposed to struck-by hazards in that the employer allowed an employee to operate a Bobcat skid steer, Model S550. A maintenance employee working for the company suffered severe neck injuries when he was struck with the load secured in it's attachment. The employee operating the Bobcat skid steer was not trained and certified to operate the machine.  Among other methods, feasible and acceptable means of hazard abatement include but are not limited to:  1. Follow Association of Equipment Manufactures (AEM) - Safety Manual - Skid Steer Loader for Operator and Maintenance Personnel, Section 7 pages 8 and 10: a) You must be a qualified and authorized operator for safe operation of this machine. You must clearly understand the written instructions supplied by the manufacturer, be trained -  including actual operation. b) Only qualified and authorized individuals may operate this equipment. 2. Follow Manufacturers Operations and Maintenance Manual - Section 1, FORWARD -  page 2 and Section 2, SAFETY AND TRAINING RESOURCES - page 10: a) PAGE 2 - WARNING: Operator must have instructions before operating  the  machine. Untrained operators can cause injury or death. b)  PAGE 10 - Operator Safety Warnings - Safety Instructions page 12 - Safe Operations Needs A Qualified Operator, A qualified operator must do the following: Have training with actual operation.
