29 CFR 1926.1203(e)(2)(v)(B): The forced air ventilation was not directed as to ventilate the immediate areas where workers are or will be present within the space and must continue until all workers have left the space; On or about February 6, 2023, and at times prior thereto, workers were refitting an auxiliary boiler that was identified as a permit-required confined space without being provided continuous forced air ventilation, exposing the workers to a hazardous atmosphere of airborne contaminants.

29 CFR 1926.1204(d)(4): The employer did not provide personal protective equipment insofar as feasible engineering and work-practice controls do not adequately protect employees. On or about February 6, 2023, and at times prior thereto, workers were refitting an auxiliary boiler that was identified as a permit-required confined space. The workers were allowed to switch from mechanical ventilation to natural ventilation without demonstrating that natural ventilation eliminated or isolated atmospheric hazards, exposing the workers to hazards associated with working in a permit-required confined space such as but not limited to asphyxiation and dizziness.
