29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). a. On or about February 19, 2023, facility wide, the employer did not ensure that employee(s) who operate powered industrial vehicles, including the Raymond pallet jack, Model 8210, Serial Number 821-18-24857, Raymond stand up pallet jack, Model 8410, Serial Number 821-19-39345, and Raymond stand up forklift, Model 425-C40QM & Model 425-C40TT, were trained and evaluated to ensure their competence to perform tasks in a safe manner, thereby exposing employees to struck-by hazards.
