29 CFR 1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:  a) Roof - the employer did not provide a written certification and documentation to OSHA that the abatement was complete, on or about August 22, 2023.  Avila's Roofing LLC was previously cited for a violation of this Occupational Safety and Health Standard 1903.19(c)(1) which was contained in OSHA inspection number 1613259, citation number 3, item number 1 and was affirmed as a final order on February 27, 2023, with respect to a workplace located at 904 Woodlawn St., Scranton, PA.  Avila's Roofing LLC was previously cited for a violation of this Occupational Safety and Health Standard 1903.19(c)(1) which was contained in OSHA inspection number 1568957, citation number 3, item number 1 and was affirmed as a final order on June 17, 2022, with respect to a workplace located at Location - 1537 West Street Honesdale, PA 18431.   Abatement Certification and Documentation Required.

29 CFR 1926.102(a)(1): Employees did not use eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  (a) 1106 Texas Palmyra Highway, Honesdale, PA 18431 - The employer allowed employees to use pneumatic nail guns to install a commercial roof  without eye protection, on or about February 15, 2023.  Abatement: With respect to all future worksites in Pennsylvania, the employer must cease and desist from permitting employees to work with pneumatic nail guns, unless each employee is wearing eye protection equipment.  Abatement certification and documentation to address the specific violation observed on or about February 15, 2023 is also required. The Date By Which Violation Must Be Abated listed below is for the specific violation observed on or about February 15, 2023. The cease and desist provision listed above is an ongoing obligation.

Abatement: With respect to all future worksites in Pennsylvania, the employer must cease and desist from permitting employees to work on walking/working surfaces with unprotected sides or edges 6 feet or more above a lower level, unless each employee is protected by a guardrail system, safety net system, or personal fall arrest system.  Abatement certification and documentation to address the specific violation observed on or about February 15, 2023 is also required.
