29 CFR 1910.133(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. Wet-mixing area: On or about March 7, 2023, in the wet mixing area where caustic chemicals such as phosphoric acid were used during the cleaning process, the workers were not provided and/or made to wear protective eye wear or face shields. One of the workers sustained an injury when acid containing mixture splattered in their of eyes.

29 CFR 1910.134(c)(1):In any workplace where respirators were necessary to protect the health of the employee or whenever respirators were required by the employer, the employer did not establish and implemented a written respiratory protection program with worksite-specific procedures. The program was not updated as necessary to reflect those changes in workplace conditions that affected respirator use. The employer did not include in the program the following provisions of this section, as applicable: Dry Mixing area: On or about March 7, 2023, in the dry mixing area where the workers wore filter piece respirators (N95 Respirators), the employer did not instruct the workers to shave their beards to maintain an effective seal of the respirators.
