29 CFR  1910.22(a)(1): The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces are kept in a clean, orderly, and sanitary condition:  On or about February 9, 2023, and times prior thereto, employees were exposed to trip/fall and struck-by hazards in the following instances (a-b):    a) In the store retail aisles, boxes of product and product carts (U-boats) were positioned in a manner that created hazards; and    b) In the stock room, boxes of product and product carts (U-boats) were stored in a manner that created hazards for employees working in and/or out of the stockroom for access to and from the cooler/freezer and the back of the stockroom when retrieving merchandise boxes.

29 CFR  1910.37(a)(3): Exit route(s) were not kept free and unobstructed:  On or about February 9, 2023, and times prior thereto, emergency exit route(s) were obstructed, exposing employees to entrapment, fire and smoke inhalation hazards, in the following instances (a-b):                                                                a) In the storage area, the employee breakroom area and product storage area walking paths leading to the emergency exit were obstructed with stacked boxes and other materials, restricting exit routes; and     b) In the rear of the store retail area near the storage room entrance, the transit path leading to the double-door storage area access was obstructed by stored merchandise, restricting the exit route.

29 CFR  1910.176(b): Material stored in tiers was not stacked, blocked, interlocked or limited in height so that it was stable and secure against sliding and collapse:  On or about February 9, 2023, and times prior thereto, the storage of materials created a hazard, exposing employees to struck-by hazards in the following instances (a-b):  a) In the store retail aisles, boxes of product on carts (U-boats) created a hazard, boxes were unstable and stacked over the top rails of the carts; and  b) In the stock room, boxes of product created a hazard such as but not limited to, boxes were unstable/leaning/sliding and greater than eight (8) feet in height exposing employees to struck-by hazards.

29 CFR  1910.176(c): Storage areas were not kept free from accumulation of materials that constituted hazards from tripping, fire, explosion, or pest harborage:  On or about February 9, 2023, and times prior thereto, storage areas were not kept free from accumulation of materials, exposing employees to tripping, and fire hazards, in the following instances (a-b):  a) the storeroom was not free of tripping and fire hazards where boxes and U-boats (merchandise carts) were strewn in an unorganized manner throughout the storage area; and        b) the employee break area was not free of tripping, fire, and potential pest harborage hazards where boxes were being tightly stacked/stored in an unorganized manner and around the refrigerator and microwave.
