29 CFR  1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:   a. Tanger Outlets Hershey - On or about February 16, 2023, employees were working inside a trench box that did not have a means of access or egress inside the shielding, exposing employees to a caught in hazard.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:   a. Tanger Outlets Hershey - On or about February 16, 2023, employees were exposed to a caught in hazard while working a trench installing a doghouse manhole, there was shielding however that did not provide complete protection for employees, the competent person on site did not identify the need to address the hazard or reevaluate the working conditions after the addition of concrete into the trench or when it began to rain softening the soil.   Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR  1926.652(d)(3): A competent person could not ensure that the material or equipment used for protective systems was able support the intended loads or was otherwise suitable for safe use, the material or equipment was not removed from service:   a. Tanger Outlets Hershey - On or about February 16, 2023, employees were working inside a trench box that was missing pins for the spreaders and was using a piece of rebar as a substitute which was not as designed in the tabulated data, the competent person failed to evaluate and ensure substitute pieces met the same tensile and load ratings of the engineered pieces, exposing employees to a caught in hazard.   Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR  1926.652(c)(2)(iii): The employer failed to follow manufacturer's specifications, recommendations, and limitations, and manufacturer's approval to deviate from the specifications, recommendations, and limitations shall be in written form at the jobsite during construction of the protective system. After that time this data may be stored off the jobsite, but a copy shall be made available to the Secretary upon request.  a. Ankiewicz Enterprises, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(c)(2)(iii), which was contained in OSHA inspection number 1521089, citation number 1, item number 1b and was affirmed as a final order on 09/27/2021, with respect to a workplace located at High Blvd & Elkins Ave. Shillington, PA 19607.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.
